นโยบายความเป็นส่วนตัวสำหรับการใช้กล้องโทรทัศน์วงจรปิด

บริษัท สยาม ทาคาชิมาย่า (ประเทศไทย) จำกัด ("เรา" หรือ "ของเรา") ใช้อุปกรณ์กล้องโทรทัศน์วงจรปิด (CCTV) ในการเฝ้าดูแลพื้นที่ภายในและรอบๆ อาคาร และสถานที่ เพื่อคุ้มครองชีวิต สุขภาพ และทรัพย์สิน เราเก็บรวบรวมข้อมูลส่วนบุคคลของลูกค้า พนักงาน กรรมการ ผู้รับจ้าง ลูกจ้าง ผู้มาเยือน หรือบุคคลใดๆ ทั้งหมดที่เข้ามาในพื้นที่ที่มีการเฝ้าดูแลภายในอาคารและสถานที่ผ่านกล้องโทรทัศน์วงจรปิด (เรียกรวมกันว่า "ท่าน" หรือ "ของท่าน") นโยบายความเป็นส่วนตัวฉบับนี้ให้ข้อมูลเกี่ยวกับการที่เราเก็บรวบรวม ใช้ เปิดเผย และโอนข้อมูลซึ่งทำให้สามารถระบุตัวบุคคลได้ ("ข้อมูลส่วนบุคคล") เกี่ยวกับท่าน เราอาจแก้ไขนโยบายนี้ได้ทุกเมื่อ และจะแจ้งให้ท่านทราบเมื่อมีการแก้ไขนโยบายหากสามารถกระทำได้

1. ข้อมูลที่เราเก็บรวบรวม

เราเก็บรวบรวมภาพนิ่งหรือภาพเคลื่อนไหว เสียง และภาพสิ่งของ เช่น ยานพาหนะของท่าน เมื่อท่านเข้าสู่พื้นที่ที่มีการสอดส่องดูแลภายในอาคารและสถานที่ของเราผ่านกล้องโทรทัศน์วงจรปิด ("ข้อมูลจากกล้องโทรทัศน์วงจรปิด")

2. เหตุใดเราจึงเก็บรวบรวม ใช้ และ/หรือเปิดเผยข้อมูลส่วนบุคคลของคุณ

2.1. เราอาจเก็บรวบรวม ใช้ เปิดเผย โอน และดำเนินการใดๆ รวมถึงแต่ไม่จำกัดเฉพาะ การบันทึก ถือครอง ปรับ เปลี่ยน แก้ไข ทำลาย ลบ กู้คืน รวม ทำสำเนา ส่ง จัดเก็บ แยก เปลี่ยน หรือเพิ่ม กับข้อมูลจากกล้องโทรทัศน์วงจรปิดและข้อมูลส่วนบุคคลอื่นๆ ที่เกี่ยวข้องกับท่าน เพื่อ "วัตถุประสงค์ในการติดตั้งกล้องโทรทัศน์วงจรปิด" ดังต่อไปนี้
- (ก) เพื่อเก็บรวบรวม สอดส่องดูแล และวิเคราะห์สถิติอัตราการเข้าและออก การเคลื่อนไหว และจราจรภายในอาคารและสถานที่ของเรา
- (ข) เพื่อปกป้องสุขภาพและความปลอดภัย รวมถึงทรัพย์สินของท่าน
- (ค) เพื่อปกป้องอาคาร สถานที่ และทรัพย์สินจากความเสียหาย ความขัดข้อง การทำลายทรัพย์สิน และอาชญากรรมอื่นๆ
- (ง) เพื่อสนับสนุนหน่วยงานบังคับใช้กฎหมายในการขัดขวาง ป้องกัน และตรวจจับอาชญากรรม รวมถึงการฟ้องร้องเมื่อเกิดอาชญากรรม
- (จ) เพื่อช่วยเหลือในการระงับข้อพิพาทที่เกิดขึ้นในกระบวนการทางวินัยหรือกระบวนการยุติเรื่องร้องทุกข์อย่างมีประสิทธิภาพ
- (ฉ) เพื่อช่วยเหลือในการสอบสวนหรือกระบวนพิจารณาที่เกี่ยวข้องกับการแจ้งเบาะแส
- (ช) เพื่อสนับสนุนในการก่อตั้งสิทธิหรือยกขึ้นเป็นต่อสู้ในการดำเนินการทางกฎหมาย ซึ่งรวมถึงแต่ไม่จำกัดเฉพาะ คดีทางแพ่ง และคดีแรงงาน
2.2. เราจะติดตั้งกล้องโทรทัศน์วงจรปิดในพื้นที่ที่กำหนดให้มีการสอดส่องดูแล
2.3. กล้องโทรทัศน์วงจรปิดของเราทำงานตลอด 24 ชั่วโมงทุกวัน
2.4. เราจะติดตั้งป้ายที่จุดทางเข้าและทางออก และในพื้นที่ที่มีการสอดส่องดูแลโดยกล้องโทรทัศน์วงจรปิด เพื่อให้ท่านทราบว่าในบริเวณนั้นมีกล้องโทรทัศน์วงจรปิด

3. ฐานทางกฎหมาย

เราจะไม่เก็บรวบรวม ใช้ เปิดเผย ประมวลผล โอน และดำเนินการใดๆ ซึ่งรวมถึงแต่ไม่จำกัดเฉพาะ การบันทึก ถือครอง ปรับเปลี่ยน แก้ไข ทำลาย ลบ กู้คืน รวม ทำสำเนา ส่ง จัดเก็บ แยก เปลี่ยน หรือเพิ่ม กับข้อมูลจากกล้องโทรทัศน์วงจรปิดและข้อมูลส่วนบุคคลอื่นๆ ที่เกี่ยวข้องกับท่านโดยไม่ได้รับความยินยอม ยกเว้นในกรณีต่อไปนี้

(ก) เพื่อรักษาประโยชน์อันจำเป็นต่อชีวิต เป็นการจำเป็นต่อการป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของบุคคล
(ข) เพื่อประโยชน์โดยชอบด้วยกฎหมาย เป็นการจำเป็นเพื่อประโยชน์โดยชอบด้วยกฎหมายของเราในการปกป้องคุ้มครองสุขภาพและความปลอดภัยของท่าน รวมถึงทรัพย์สินของท่าน อาคาร สถานที่ และทรัพย์สินของเราและกระทำการอื่นใดเพื่อให้เป็นไปตามวัตถุประสงค์ในการติดตั้งกล้องโทรทัศน์วงจรปิด เราจะพยายามสร้างความสมดุลระหว่างประโยชน์โดยชอบด้วยกฎหมายของเราและของบุคคลภายนอกที่เกี่ยวข้อง แล้วแต่กรณี รวมถึงสิทธิเสรีภาพขั้นพื้นฐานของท่านในการคุ้มครองข้อมูลจากกล้องโทรทัศน์วงจรปิดที่เกี่ยวข้องกับท่าน นอกจากนี้ เราจะใช้ความพยายามในการหาขั้นตอนวิธีการเพื่อให้ได้มาซึ่งสมดุลดังกล่าวตามความเหมาะสม
(ค) เพื่อปฏิบัติหน้าที่ตามกฎหมาย เรามีหน้าที่ในการปฏิบัติตามกฎหมายที่ใช้บังคับ ซึ่งรวมถึงแต่ไม่จำกัดเฉพาะ กฎหมายที่เกี่ยวข้องกับความปลอดภัยและสภาพแวดล้อมการทำงาน เราเห็นว่าการใช้กล้องโทรทัศน์วงจรปิดเป็นมาตรการที่จำเป็นที่จะทำให้เราสามารถปฏิบัติตามหน้าที่ดังกล่าวได้

4. บุคคลที่เราเปิดเผยและ/หรือโอนข้อมูลส่วนบุคคลของท่าน

4.1. เราจะเก็บข้อมูลจากกล้องโทรทัศน์วงจรปิดที่เกี่ยวข้องกับท่านไว้เป็นความลับ และจะไม่เปิดเผยหรือโอนข้อมูลดังกล่าวให้แก่ผู้ใด ยกเว้นบริษัทย่อย บริษัทในเครือ บุคคลภายนอกที่เราคัดเลือกอย่างระมัดระวังทั้งในปัจจุบันและอนาคต ผู้ที่ได้รับสิทธิ หุ้นส่วนของกิจการร่วมค้า และ/หรือผู้ให้บริการ ซึ่งอาจอยู่ในต่างประเทศ เพื่อให้เป็นไปตามวัตถุประสงค์ในการติดตั้งกล้องโทรทัศน์วงจรปิดที่ระบุในนโยบายนี้
4.2. บุคคลภายนอกที่เราอาจเปิดเผยข้อมูลจากกล้องโทรทัศน์วงจรปิดและข้อมูลส่วนบุคคลอื่นๆ ที่เกี่ยวกับท่าน รวมถึง
- (ก) กลุ่มบริษัทสยามพิวรรธน์และบริษัทในเครือ เราอาจเปิดเผยหรือโอนข้อมูลจากกล้องโทรทัศน์วงจรปิดและข้อมูลส่วนบุคคลอื่นที่เกี่ยวกับท่านให้แก่กลุ่มบริษัทสยามพิวรรธน์และบริษัทในเครือ เพื่อประโยชน์โดยชอบด้วยกฎหมายของเราและของเราในเครือในการทำตามวัตถุประสงค์ในการติดตั้งกล้องโทรทัศน์วงจรปิด
- (ข) หน่วยงานรัฐและ/หรือหน่วยงานบังคับใช้กฎหมาย เราอาจเปิดเผยข้อมูลจากกล้องโทรทัศน์วงจรปิดและข้อมูลส่วนบุคคลอื่นที่เกี่ยวกับท่านเพื่อปฏิบัติตามกฎหมาย หรือเพื่อสนับสนุนหรือช่วยเหลือหน่วยงานบังคับใช้กฎหมายในการสอบสวนหรือดำเนินกระบวนพิจารณาในคดีแพ่งหรืออาญา
- (ค) ผู้ให้บริการจากภายนอก เราอาจเปิดเผยหรือโอนข้อมูลจากกล้องโทรทัศน์วงจรปิดและข้อมูลส่วนบุคคลอื่นที่เกี่ยวกับท่านเพื่อดำเนินการตามขั้นตอนที่จำเป็นในการปกป้องสุขภาพ ความปลอดภัย และทรัพย์สินของท่าน

5. การโอนข้อมูลไปต่างประเทศ

5.1. เราอาจเปิดเผยหรือโอนข้อมูลของท่านจากกล้องโทรทัศน์วงจรปิดไปยังผู้ให้บริการจากภายนอก ที่อยู่นอกประเทศไทย เพื่อดำเนินการตามขั้นตอนที่จำเป็นในการปกป้องสุขภาพ ความปลอดภัย และทรัพย์สินของท่าน การเปิดเผยหรือโอนข้อมูลดังกล่าวจะกระทำได้ต่อเมื่อได้รับความยินยอมจากท่านเท่านั้น เว้นแต่จะมีฐานทางกฎหมายที่สำคัญอื่นๆ (เช่น เพื่อปฏิบัติตามสัญญาระหว่างเราและบุคคลอื่นเพื่อประโยชน์ของท่าน) ตามที่กฎหมายที่ใช้บังคับกำหนด
5.2. ถ้าข้อมูลของท่านจากกล้องโทรทัศน์วงจรปิดถูกโอนไปยังประเทศปลายทางที่มาตรฐานการคุ้มครองข้อมูลไม่เพียงพอตามที่กฎหมายคุ้มครองข้อมูลส่วนบุคคลของประเทศไทยกำหนด เราจะดำเนินการตามขั้นตอนที่จำเป็นในการคุ้มครองข้อมูลส่วนบุคคลที่โอนไปยังบุคคลอื่นในต่างประเทศ เพื่อให้ข้อมูลนั้นได้รับการคุ้มครองในระดับเดียวกับที่เราคุ้มครองข้อมูลของท่านจากกล้องโทรทัศน์วงจรปิด ตามกฎหมายว่าด้วยการคุ้มครองข้อมูลส่วนบุคคลที่บังคับใช้อยู่ในขณะนั้น

6. มาตรการรักษาความปลอดภัย

6.1. เราใช้มาตรการรักษาความปลอดภัยเชิงองค์กร และเชิงบริหารจัดการตามสมควรในการคุ้มครองข้อมูลจากกล้องโทรทัศน์วงจรปิดและข้อมูลส่วนบุคคลที่เกี่ยวกับท่านจากความเสียหาย การสูญหาย การเข้าถึง การใช้ การเปลี่ยนแปลง หรือการเปิดเผยโดยอุบัติเหตุ โดยมิชอบ หรือโดยปราศจากอำนาจ
6.2. เราจะทำการตรวจสอบและปรับปรุงมาตรการรักษาความปลอดภัยของเราเป็นครั้งคราวตามที่จำเป็นหรือเมื่อมีการพัฒนาเทคโนโลยีที่เกี่ยวข้อง เพื่อให้แน่ใจว่ามาตรการรักษาความปลอดภัยมีประสิทธิภาพและเหมาะสม และเป็นไปตามข้อกำหนดขั้นต่ำทางกฎหมาย ตามที่หน่วยงานรัฐบาลที่เกี่ยวข้องกำหนด

7. ระยะเวลาในการเก็บรักษาข้อมูลส่วนบุคคล

เราจะเก็บรักษาข้อมูลของท่านจากกล้องโทรทัศน์วงจรปิดในระบบของเราเป็นระยะเวลาที่จำเป็นต่อการดำเนินการตามหน้าที่เพื่อให้บรรลุวัตถุประสงค์ในการติดตั้งกล้องโทรทัศน์วงจรปิดที่ระบุในนโยบายนี้ เมื่อเราไม่ได้รับอนุญาตตามกฎหมายให้เก็บข้อมูลของท่านจากกล้องโทรทัศน์วงจรปิดอีกต่อไป เราจะทำการลบข้อมูลออกจากระบบและบันทึกของเรา อย่างไรก็ตาม ในกรณีที่มีการดำเนินการทางศาลหรือทางวินัย ข้อมูลของท่านจากกล้องโทรทัศน์วงจรปิดอาจถูกเก็บไว้จนกว่าจะสิ้นสุดการดำเนินการดังกล่าว รวมถึงระยะเวลาที่เป็นไปได้ในการยื่นอุทธรณ์ หลังจากนั้นข้อมูลจะถูกลบหรือเก็บถาวรตามที่กฎหมายที่ใช้บังคับกำหนด

8. สิทธิตามกฎหมายของท่าน

ท่านมีสิทธิภายใต้กฎหมายที่ใช้บังคับ กฎระเบียบภายในของเรา และข้อยกเว้นต่างๆ ดังต่อไปนี้

(ก) สิทธิในการเข้าถึงข้อมูล ท่านอาจมีสิทธิเข้าถึงและขอรับสำเนาของข้อมูลส่วนบุคคลที่เราเก็บรวบรวม ใช้ และเปิดเผยเกี่ยวกับท่าน เพื่อความเป็นส่วนตัวและความปลอดภัยของคุณ เราอาจขอให้คุณยืนยันตัวตนก่อนให้ข้อมูลที่คุณขอ
(ข) สิทธิในการแก้ไขข้อมูลให้ถูกต้อง ท่านอาจมีสิทธิขอให้เราแก้ไขข้อมูลส่วนบุคคลของท่านที่เราเก็บรวบรวม ใช้ และเปิดเผยหากข้อมูลนั้นไม่สมบูรณ์ ไม่ถูกต้อง ก่อให้เกิดความเข้าใจผิด หรือไม่เป็นปัจจุบัน
(ค) สิทธิในการโอนย้ายข้อมูล ท่านอาจมีสิทธิที่จะได้รับข้อมูลส่วนบุคคลเกี่ยวกับท่านที่เราครอบครองอยู่ ในรูปแบบอิเล็กทรอนิกส์ที่สามารถอ่านหรือใช้งานโดยทั่วไปได้ และส่งข้อมูลดังกล่าวให้กับผู้ควบคุมข้อมูลอื่น โดยที่ข้อมูลนั้นจะต้องเป็นข้อมูลส่วนบุคคลที่ท่านได้ให้ไว้แก่เราและเป็น ข้อมูลที่เราประมวลผลบนฐานความยินยอมของท่านหรือเพื่อปฏิบัติตามสัญญาที่มีกับท่าน
(ง) สิทธิในการคัดค้าน ท่านอาจมีสิทธิคัดค้านการเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลของท่านบางรายการได้ เช่น คัดค้านไม่ให้ใช้เพื่อทำการตลาดทางตรง เป็นต้น
(จ) สิทธิในการระงับการใช้ข้อมูลชั่วคราว ท่านอาจมีสิทธิขอให้เราระงับการใช้ข้อมูลส่วนบุคคลของท่านได้ในบางกรณี
(ฉ) สิทธิในการถอนความยินยอม ท่านอาจมีสิทธิถอนความยินยอมที่ท่านได้ให้ไว้กับเราเพื่อวัตถุประสงค์ในการเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลของท่านได้ทุกเมื่อ
(ช) สิทธิในการลบข้อมูล ท่านอาจมีสิทธิขอให้เราลบข้อมูลของท่านหรือทำให้ข้อมูลของท่านเป็นข้อมูลที่ไม่สามารถระบุตัวบุคคลได้ เว้นแต่ว่าเราไม่จำเป็นต้องดำเนินการดังกล่าวหากเราต้องเก็บรักษาข้อมูลดังกล่าวเพื่อการปฏิบัติตามหรือการใช้สิทธิเรียกร้องตามกฎหมาย หรือเพื่อการยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย
(ซ) สิทธิในการร้องเรียน ท่านอาจมีสิทธิร้องเรียนต่อหน่วยงานที่เกี่ยวข้องหากท่านเชื่อว่าการเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลของท่านนั้นไม่ชอบด้วยกฎหมายหรือไม่เป็นไปตามกฎหมายการคุ้มครองข้อมูลส่วนบุคคล

Privacy Policy on CCTV Use

Siam Takashimaya (Thailand) Company Limited ("we", "us", or "our") is using closed-circuit television (CCTV) devices for monitoring our designated space within and around our buildings and facilities to protect life, health, and property. We collect personal data of all customers, tenants, employees, directors, contractors, workers, visitors, or any individuals entering the monitored space within our buildings and facilities (collectively referred to as "you" or "your") through the use of CCTV devices. This privacy policy provides information on our collection, use, disclosure, and transfer of individually identifiable information ("Personal Data") about you. We may amend this policy at any time and will notify you of the amendments, where possible.

1. What Personal Data we collected

We may collect your moving or still images, voice and belongings e.g., vehicles, when you enter the monitored space in our buildings and facilities through the CCTV devices ("CCTV Data").

2. Why we collect, use and/or disclose your Personal Data

2.1 We may collect, use, disclose, transfer, and/or carry out any operation, including but not limited to recording, holding, adapting, altering, modifying, destroying, deleting, retrieving, combining, copying, transmitting, storing, extracting, amending, or adding, related to your CCTV Data and other Personal Data concerning you, for the "CCTV Monitoring Purposes" as listed below:
- (a) to collect, monitor and analyze the statistics about entry and exit rates, movement and traffic within our buildings and facilities;
- (b) to protect your health and personal safety, including your belongings;
- (c) to protect our buildings, facilities and assets from damage, disruption, vandalism, and other crime;
- (d) to support law enforcement organizations in the deterrent, prevention, detection, and prosecution of crime;
- (e) to assist in the effective resolution of disputes which arise in the course of disciplinary or grievance proceedings;
- (f) to assist in the investigation or proceedings concerning a whistleblowing complaint; and
- (g) to assist in the establishment or defense of any civil litigation, including but not limited to employment proceedings.
2.2 We will install CCTV devices in designated monitored areas.
2.3 Our CCTV devices are in operation 24 hours a day and 365 days a year.
2.4 We will place signage at least at the entrance and exit points, and the monitored areas to alert you that a CCTV installation is in use.

3. Legal bases

We will not collect, use, disclose, process, transfer, and/or carry out any operation, including but not limited to recording, holding, adapting, altering, modifying, destroying, deleting, retrieving, combining, copying, transmitting, storing, extracting, amending, or adding, related to your CCTV Data and other Personal Data concerning you, without consent except for the following:

(a) Vital interest. It is necessary for our prevention or suppression of a danger to a person's life, body, or health;
(b) Legitimate interest. It is in our legitimate interest to protect your health and personal safety, as well as your belongings, our buildings, facilities and assets, and to carry out any other acts to achieve the CCTV Monitoring Purposes. We will endeavor on the continuing basis to balance our legitimate interest and that of any relevant third parties, as the case maybe, and your fundamental rights and freedoms related to the protection of the CCTV Data concerning you. We will also endeavor to identify any steps required to achieve the right balance as appropriate;
(c) Legal obligations. We owe a duty to comply with the legal obligations prescribed by the applicable laws, including but not limited to the laws regarding safety and environment in the workplace. We consider the use of the CCTV as a necessary measure to enable us to meet those obligations.

4. To whom we may disclose or transfer your Personal Data

4.1 We will keep CCTV Data concerning you confidential and will not disclose or transfer it except to our subsidiaries, affiliates, and other carefully selected third parties now or in the future, licensees, joint venture partners, and/or service providers, who may be located overseas, to achieve the CCTV Monitoring Purposes provided in this policy.
4.2 Third parties to which we may disclose CCTV Data and other Personal Data concerning you include:
- (a) Siam Piwat Group and our affiliates. We may disclose or transfer CCTV Data and other Personal Data concerning you to Siam Piwat Group and our affiliated companies, as part of our legitimate interest and our affiliates' interest to achieve the CCTV Monitoring Purposes.
- (b) Governmental and /or regulatory organizations. We may disclose or transfer CCTV Data and other Personal Data concerning you to comply with legal obligations, or to support or assist law enforcement organizations with regard to the investigation and prosecution of civil or criminal proceedings.
- (c) Third-party service providers. We may disclose or transfer CCTV Data and other Personal Data concerning you as our necessary steps to ensure our protection of your health and personal safety, and belongings.

5. International transfers of your Personal Data

5.1 We may disclose or transfer your CCTV Data as part of necessary steps to ensure your health, personal safety, and belongings, to third-party service providers that are outside of Thailand. Such disclosure or transfer may only be done by obtaining your consent, unless there are any other compelling legitimate grounds (e.g. to perform the contract terms between us and other persons for your benefit) as permitted by applicable laws.
5.2 If your CCTV Data is transferred to destination countries where the standard of protection available is not sufficient under the applicable laws on data protection in Thailand, we will take steps necessary to protect the Personal Data transferred to other persons internationally to reach the same level of protection as required by applicable Thai laws on data protection which is in effect at that time.

6. Security measures

6.1 We use reasonable organizational and administrative security measures to protect CCTV Data and Personal Data concerning you from accidental, unlawful, or unauthorized destruction, loss, access, use, alteration, or disclosure.
6.2 We will from time to time review and update our security measures to be in line with minimum legal requirements as prescribed by the relevant governmental organizations.

7. How long do we keep your Personal Data

We will retain your CCTV Data in our system for the period necessary to fulfil our duties to achieve the CCTV Monitoring Purposes prescribed in this policy. When we are no longer permitted by the applicable laws to store your CCTV Data, we will remove it from our systems and records. In the event a judicial or disciplinary action is initiated, your CCTV Data may be stored until the end of such action, including any potential periods for appeal, and will then be deleted or archived as permitted by the applicable laws.

8. Your rights as a data subject

Subject to applicable laws, our internal rules and exceptions thereof, if necessary, you may have the following rights to:

1) Access: You may have the right to access or request a copy of the Personal Data we are collecting, using and disclosing about you. For your own privacy and security, we may require you to prove your identity before providing the requested information to you.
2) Rectification: You may have the right to have incomplete, inaccurate, misleading, or out-of-date Personal Data that we collect, use and disclose about you rectified.
3) Data Portability: You may have the right to obtain Personal Data we hold about you, in a structured, electronic format, and to send or transfer this data to another data controller, as long as you had provided this Personal Data to us, and we had been processing this data on the basis of your consent or to perform a contract with you.
